VIRGINIA LOTTERY BOARD
AGENCY SUMMARY
The Virginia Lottery is an independent agency of the Commonwealth, exclusive of the legislative, executive or judicial branches of government. The Virginia Lottery Law was approved by the 1987 Virginia General Assembly and by a majority of voters in a referendum held on November 3, 1987.
The Virginia Lottery Board is authorized to adopt regulations governing the establishment and operation of a lottery and privately-operated sports betting and casino gaming programs. The regulations are required to provide for all matters necessary or desirable for the efficient, honest and economical operation and administration of the lottery and sports betting and for the convenience of the purchasers of tickets or shares and the holders of winning tickets or shares, and sports bettors. They may be amended, repealed or supplemented as necessary, and, for lottery, include type of lottery, ticket price, numbers and sizes of prizes, manner of selecting and payment of winning tickets, frequency of drawings, licensing of agents and their compensation, and apportionment of revenues. For sports betting, the board's regulations must establish a consumer protection program and bill of rights. The board is also required to promulgate regulations establishing and implementing a voluntary exclusion program and regulations regarding agency procurement and for an annual license fee to be collected from each lottery sales agent. Such fee is to be designed to recover all or such portion of the installation and annual operational costs borne by the agency in providing services to the agent. For casino gaming, the board must adopt regulations regarding the conditions under which casino gaming and on-site mobile casino gaming may be conducted in the Commonwealth and such other regulations as it deems necessary and appropriate to further the purposes of the Casino Gaming Law.
The Director of the Virginia Lottery is authorized to supervise and administer the operations of the lottery in accordance with the provisions of the Virginia Lottery Law and the rules and regulations of the board and the regulation of casino gaming in accordance with the Casino Gaming Law. The Director also is required to establish by rule and regulation a set-off debt collection program in accordance with the provisions of the Setoff Debt Collection Act, Article 21 of Chapter 3 of Title 58.1, wherein certain prizes are subjected to delinquent debts of agencies and institutions of the Commonwealth.
