18VAC10-20-680. Reinstatement.
A. Applicants whose license, certificate, or business entity registration has been expired for more than six months will be required to submit a reinstatement application, which will be evaluated by the board to determine if the applicant remains qualified to be a regulant of the board.
B. Applicants whose license or certificate has been expired for more than five years will be required to reapply for licensure or certification on the initial application and document experience from the date of expiration of the license or certificate to the present.
C. The board may require an exam, continuing education, or experience for architects, professional engineers, land surveyors, landscape architects, and interior designers whose license or certificate has been expired for more than five years.
D. The board may deny reinstatement of a license, certificate, or registration for the same reasons as it may refuse initial licensure, certification, or registration or for the same reasons that it may discipline a regulant for noncompliance with the requirements contained in this chapter. The applicant has the right to request further review of any such action by the board under the Administrative Process Act (§ 2.2-4000 et seq. of the Code of Virginia).
E. The date the reinstatement fee is received in the board's office will determine the amount to be paid pursuant to the following requirements:
1. Licenses, certificates, and registrations that have been expired for more than six months, but less than five years will require a reinstatement fee that will equal the renewal fee plus $200.
2. Licenses, certificates, and registrations that have been expired for more than five years will require a reinstatement fee that will equal the renewal fee plus $300.
F. Licensees will remain under and be subject to all laws and regulations as if the licensee had been continuously licensed. The licensee will remain under and be subject to the disciplinary authority of the board during this entire period at all times, regardless of whether the license is reinstated, pursuant to § 54.1-405 of the Code of Virginia.
G. A certificate or registration holder who reinstates will be regarded as having been current and without interruption and under the authority of the board.
H. Failure to pay any monetary penalty, reimbursement of cost, or other fee assessed by consent order or final order will result in a delay or withholding of services provided by the department such as, but not limited to, renewal, reinstatement, or processing a new application.
