BOARD OF HEALTH PROFESSIONS

AGENCY SUMMARY

The Board of Health Professions is a policy board housed within the Department of Health Professions. For the statutory authority of the boards within the department, see Subtitle III (§ 54.1-2400 et seq.) of Title 54.1 of the Code of Virginia.

The board is authorized under Chapters 24 (§ 54.1-2400 et seq.) and 25 (§ 54.1-2500 et seq.) of Title 54.1 of the Code of Virginia to evaluate the need for coordination among health profession regulatory boards within the department; evaluate all health occupations and professions in the Commonwealth and recommend whether each should be regulated; monitor the policies and activities of the department; comment, as appropriate, on all regulations proposed or promulgated by the boards of the department; and review enforcement and discipline processes of the boards and the department.

In addition, the board is authorized to promulgate regulations to administer the Practitioner Self-Referral Act (§ 54.1-2410 et seq. of the Code of Virginia), which establishes the framework for determining the legality of investment, referral, and other activities of licensed, certified, and unregulated health care practitioners and entities in the Commonwealth. 

In addition to functions concerned with the separate health boards, the board is authorized by Chapter 27.1 (§ 54.1-2730 et seq.) of Title 54.1 of the Code of Virginia to adopt regulations to establish the minimum requisite education, training, and experience necessary to hold oneself out as a dietitian or nutritionist. 

The board is also authorized by Chapter 27.01 (§ 54.1-2729.1 et seq.) of Title 54.1 of the Code of Virginia to approve organizations to certify dialysis patient care technicians or dialysis care technicians.
