STATE BOARD OF LOCAL AND REGIONAL JAILS
AGENCY SUMMARY
The State Board of Local and Regional Jails, formerly the State Board of Corrections, is established in Article 2 (§ 53.1-2 et seq.) of Chapter 1 of Title 53.1. The board may appoint and employ an executive director and such other persons as it deems necessary to assist the board in carrying out its duties. Title 53.2, Chapter 1, Article 2. The role of the board is to establish standards and guidelines for local and regional jails that are designed to guarantee the health, safety, and welfare of staff and offenders under its jurisdiction. All references to Title 53.1 in this Agency Summary are to Title 53.1 of the Code of Virginia.
The State Board of Local and Regional Jails is authorized to:
Establish operational and fiscal standards governing the operation of local and regional correctional facilities. Title 53.1, Chapter 1, Article 2.
Establish minimum standards for health care services in local, regional, and community correctional facilities and procedures for enforcing such minimum standards. Title 53.1, Chapter 1, Article 2.
Develop and implement policies and procedures for the review of the death of any inmate that the board determines warrants review that occurs in any local, regional, or community correctional facility. Title 53.1, Chapter 1, Article 2.
Establish minimum standards for the construction, equipment, administration, and operation of local correctional facilities and lockups. Title 53.1, Chapter 3, Articles 1, 1.1, and 8.
Prescribe standards for the development, implementation, operation, and evaluation of programs, services, and facilities for a local community-based corrections system. Title 53.1, Chapter 2, Article 6.
Hold and conduct hearings; issue subpoenas requiring the attendance of witnesses and the production of records, memoranda, papers, and other documents; and administer oaths and take testimony thereunder. Title 53.1, Chapter 1, Article 2.
Limit, by its order, the confinement of prisoners in any local correctional facility or lock-up, which is not constructed, equipped, maintained and operated so as to comply with minimum standards prescribed by the board, either by prohibiting confinement of any prisoners in such local correctional facility or lock-up, or by limiting the maximum number of prisoners to be confined therein, as the board deems appropriate. Title 53.1, Chapter 3, Article 1.
Make, adopt, and promulgate regulations governing the following aspects of private management and operation of regional jail facilities: (i) minimum standards for the construction, equipment, administration, and operation of the facilities; (ii) contingency plans for operation of a contractor-operated facility in the event of a termination of the contract; (iii) use of deadly and nondeadly force by regional jail facility contractors' security personnel; (iv) methods of monitoring a contractor-operated facility by an appropriate state or local governmental entity or entities; (v) public access to a contractor-operated facility; and (vi) such other regulations as may be necessary to carry out the provisions of Article 1 of Chapter 3 of Title 53.1. Authorized to make, adopt and promulgate such rules and regulations as may be necessary to carry out the provisions of this Title 53.1 and other laws of the Commonwealth pertaining to local, regional facilities. Code of Virginia, Title 53.1, Chapter 1, Article 2.
Chapter 759 of the 2020 Acts of Assembly renamed the State Board of Corrections as the State Board of Local and Regional Jails and clarified the authority and duties of the board in relation to the Department of Corrections.
