9VAC25-780-10. Application.

A. All local governments in the Commonwealth of Virginia shall participate in cross-jurisdictional, coordinated water resource planning and shall develop and submit, with the other local governments within a regional planning area, a single jointly produced regional water plan to the board. To the extent any provision of this chapter is applicable to or otherwise affects an application for a permit, license, grant, loan, or request for funding of any kind made to a state or federal agency, such application shall be subject to the version of this chapter in effect on the date the application is submitted. All projects shall remain subject to applicable federal and state regulatory requirements.

B. Nothing in this chapter shall be construed as altering or authorizing any alteration of any existing surface water, groundwater, or common law water rights; contractual rights or obligations relating to water supplies; or rights to freely enter into contracts or agreements relating to water supplies of any local government, water authority, or person, except as required by federal or state law.

C. The review required by 9VAC25-780-140 shall not be a prerequisite for applying for a permit from the Commonwealth of Virginia for a water supply project.
