An Act to provide for the sale of surplus property from the Pocahontas Building as part of the General Assembly replacement project and the transfer of all proceeds to a special nonreverting fund for the restoration and ongoing preservation of Capitol Square.

Be it enacted by the General Assembly of Virginia:
1. § 1. Notwithstanding any other provision of law, the Department of General Services, in cooperation with the Clerks of the Senate of Virginia and the House of Delegates, shall conduct one or more public sales or auctions of the surplus property from the Pocahontas Building as part of the General Assembly replacement project. No provision of law shall be construed to restrict the purchase of such surplus property by any person at a public sale or auction held pursuant to this act. Any net proceeds of such public sales or auctions, less actual direct costs incurred by the Department of General Services, the Clerk of the Senate of Virginia, and the Clerk of the House of Delegates, shall be deposited into a special nonreverting fund created on the books of the State Comptroller to be administered by the Capitol Square Preservation Council. The Capitol Square Preservation Council shall transfer all moneys in such fund to the Virginia Capitol Foundation, but only after entering into an agreement with the Virginia Capitol Foundation to use such funds to support the restoration and ongoing preservation of Capitol Square, as defined in § 30-193 of the Code of Virginia. For purposes of this act, "surplus property" means any personal property that is determined jointly by the Clerks of the Senate of Virginia and the House of Delegates to be salvageable surplus property, including all fixtures, furnishings, materials, supplies, equipment, and recyclable items.
