VIRGINIA CODE COMMISSION

AGENCY SUMMARY

The Virginia Code Commission is established in the legislative branch of state government and is governed by the Virginia Register Act (§ 2.2-4100 et seq. of the Code of Virginia), § 2.2-4031, and Chapter 15 (§ 30-145 et seq.) of Title 30 of the Code of Virginia. The commission's primary responsibilities include the compilation and publication of the Code of Virginia and the Virginia Administrative Code (VAC), the annual codification of the Virginia Acts of Assembly, and the biweekly publication of the Virginia Register of Regulations.

Section 2.2-4102 of the Code of Virginia establishes the position of Registrar of Regulations (Registrar) and requires the commission to provide for the compilation and publication of the Virginia Register of Regulations and VAC pursuant to §§ 2.2-4031 and 30-146 of the Code of Virginia.

Section 2.2-4103 of the Code of Virginia requires, with some exceptions, each state agency to file the full text of its administrative regulations with the Registrar, and § 2.2-4103.1 of the Code of Virginia requires state agencies to annually file any guidance documents with the Registrar.

Section 2.2-4104 of the Code of Virginia authorizes the commission, through the Registrar, to advise agencies on the form and style of regulations and to formulate and issue regulations regarding the nature and content of VAC.

Section 2.2-4031 of the Code of Virginia requires the commission to publish biweekly the Virginia Register of Regulations, which shall include all (i) proposed and final regulations, (ii) emergency regulations, (iii) executive orders, (iv) notices of public hearings on regulations, and (v) petitions for rulemaking made in accordance with § 2.2-4007 of the Code of Virginia.

Section 30-146 of the Code of Virginia requires the commission to publish and maintain the Code of Virginia and grants discretion to the commission regarding the organization, form, and makeup of the Code of Virginia, VAC, and the Virginia Register of Regulations.

Section 30-148 of the Code of Virginia requires the commission to annually codify and incorporate into the Code of Virginia all statutes enacted by the General Assembly during regular and special sessions prior to the date those statutes become effective.

Sections 30-149 and 30-150 of the Code of Virginia authorize the commission to make minor changes to the Code of Virginia and VAC, including correcting unmistakable errors; making purely consequential changes to terminology and titles of officers and agencies; and renumbering, renaming, and rearranging the divisions of VAC.

Section 30-151 of the Code of Virginia requires the commission to identify, on an ongoing basis, obsolete portions of the Code of Virginia and uncodified provisions in the Acts of Assembly and to recommend to the General Assembly, at least every four years, the amendment or repeal of those statutes or acts.
