VIRGINIA WORKERS' COMPENSATION COMMISSION

AGENCY SUMMARY

The Virginia Workers' Compensation Commission is authorized to adjudicate claims by workers and their dependents for awards for disability or death arising from occupational diseases or injuries. Employers subject to the Workers' Compensation Act (Title 65.2 of the Code of Virginia) are required to carry approved workers' compensation insurance, to obtain from the Commission self-insurance certificates evidencing financial responsibility, or to belong to a licensed group self-insurance association. The insurance companies, although primarily regulated by the State Corporation Commission, are required to file notices and reports with the Workers' Compensation Commission, as are employers. The Workers' Compensation Commission is directed to collect from insurers and self-insured employers the taxes imposed to finance administration of the Act. It is authorized to make regulations to carry out the Act and, jointly with the State Corporation Commission, to prescribe minimum standards of service for insurers. It may fine employers or insurers for violations and may order cessation of business pending compliance. (Code of Virginia, Title 65.2, Chapter 2)

The Commission is authorized to promulgate regulations to ensure that information for the purpose of determining eligibility for employment will not be provided without the written consent of the employee. (Code of Virginia, Title 65.2, Chapter 9)

The Commission is authorized to adopt medical fee schedules that determine the maximum pecuniary liability of employers for fee scheduled medical services as defined in Va. Code Sec. 65.2-605.

The Commission is authorized to adjudicate claims by victims of crime, or their surviving spouses, children, or dependents, for awards for physical injury or death. It is authorized to make regulations to carry out the Compensating Victims of Crime Act, which provides for such compensation. (Code of Virginia, Title 19.2, Chapter 21.1)

The Commission is authorized to adjudicate claims made against the Birth-Related Neurological Injuries Compensation Fund.
