STATE CORPORATION COMMISSION, DIVISION OF UTILITY AND RAILROAD SAFETY

AGENCY SUMMARY

The State Corporation Commission is vested with the duty of regulating railroad companies to the extent provided by statute. Article IX, Section 2 of the Constitution of Virginia. The statutes provide for the commission to enforce intrastate rail rates in accordance with the Stagger Rail Act of 1980, P.L. 96-448; to prescribe conditions for telephone, telegraph, or electric lines to cross railroads in instances where parties cannot agree; to decide certain controversies between railroad companies and the Commonwealth Transportation Commissioner or local governing bodies relating to construction or maintenance of highway grade crossings; to investigate the cause of any railroad accident when it deems investigation warranted; and to inspect railroad facilities for compliance with safety regulations. Code of Virginia, Title 56, Chapters 1, 6 and 13. The commission may decide certain controversies between landowners and railroads. Code of Virginia, Title 10.1, Chapter 11, Article 6.
