9VAC25-101-35. Oil discharge contingency plan and vessel response plan requirements for state waters.

No operator of a tank vessel shall cause or permit a tank vessel to transport or transfer oil in state waters unless an oil discharge contingency plan applicable to the tank vessel is filed with and approved by the department in accordance with 9VAC25-101-40 or a Vessel Response Plan applicable to the tank vessel has been approved by the United States Coast Guard pursuant to § 4202 of the federal Oil Pollution Act of 1990, Pub. L. No. 101-380, 33 USC § 1321(j).
