9VAC25-670-20. Purpose.

The purpose of this chapter is to establish VWP General Permit Number WP2 under 9VAC25-210 to govern permanent and temporary impacts related to the construction and maintenance of utility lines. Applications for coverage under this VWP general permit shall be processed for approval, approval with conditions, or denial by the department. Coverage, coverage with conditions, or application denial by the department shall constitute the VWP general permit action and shall follow all provisions in the State Water Control Law (§ 62.1-44.2 et seq. of the Code of Virginia), except for the public comment and participation provisions, from which each VWP general permit action is exempt.
