DEPARTMENT OF AGRICULTURE AND CONSUMER SERVICES, CHARITABLE GAMING
AGENCY SUMMARY
The Department of Agriculture and Consumer Services promulgates regulations concerning charitable gaming activities in the Commonwealth. The agency is tasked with the duties and responsibilities associated with administering the provisions of the Charitable Gaming Law (§ 18.2-340.15 et seq. of the Code of Virginia) as well as the regulations promulgated pursuant thereto in order to promote the integrity of charitable gaming activities throughout Virginia.
The agency issues permits to organizations wishing to conduct charitable gaming, charitable gaming suppliers, manufacturers of electronic pull-tab systems, and network bingo providers; registers bingo callers, bingo managers, Texas Hold'em poker tournament operators, and landlords; and authorizes certain charitable organizations to conduct electronic gaming. The agency provides training and technical assistance to organizations and individuals involved in charitable gaming. The agency conducts audits and financial reviews of organizations to ensure compliance with financial reporting requirements, applicable laws and regulations, and use-of-proceeds requirements. The agency conducts financial reviews of charitable gaming suppliers, manufacturers of electronic pull-tab systems, and network bingo providers to ensure compliance with the sales transaction report requirements and other applicable laws and regulations. The agency conducts onsite inspections of charitable gaming locations, investigates violations of the Charitable Gaming Law and regulations adopted pursuant thereto, and pursues regulatory action against or prosecution of violators.
The agency is also required to promulgate regulations to implement various chapters of the Code of Virginia, including those established in Title 3.2 of the Code of Virginia regarding agriculture, animal care, and food. These regulations are established in Title 2 of the Virginia Administrative Code under Agency No. 5.
